Agreement to Terms

Welcome to Aerotlampr. These Terms of Service ("Terms") govern your access to and use of the Aerotlampr website ("Site") and all services offered by Aerotlampr ("Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.

Services

Aerotlampr offers public speaking courses, workshops, private coaching, corporate training, and speech writing services. The specific details, duration, and content of each Service are as described on our Site or in a separate agreement.

We reserve the right to modify, suspend, or discontinue any portion of our Services at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of our Services.

Payments and Refunds

All fees for our Services are as stated on our Site or in a separate agreement. Payment must be made in full prior to the commencement of any Service unless otherwise specified.

Refund Policy:

• Group Courses and Workshops: Full refund if cancelled 14 days or more before the start date. 50% refund if cancelled 7-13 days before the start date. No refund for cancellations less than 7 days before the start date.
• Private Coaching: Full refund if cancelled 48 hours or more before the scheduled session. No refund for cancellations less than 48 hours before the scheduled session.
• Corporate Training: Refund policy as per the individual corporate agreement.

All refund requests must be submitted in writing to [email protected].

Cancellations and Rescheduling

For Group Courses and Workshops:

• We reserve the right to cancel or reschedule any course or workshop due to insufficient enrollment, instructor illness, or other unforeseen circumstances. In such cases, you will be offered a full refund or the option to transfer to another course or workshop.

For Private Coaching:

• You may reschedule a private coaching session without penalty if notice is provided at least 48 hours before the scheduled session. Sessions cancelled with less than 48 hours' notice are not eligible for rescheduling or refund.

For Corporate Training:

• Cancellation and rescheduling terms as per the individual corporate agreement.

Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Aerotlampr, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

User Content

Our Services may allow you to post, submit, publish, display, or transmit content or materials ("User Content"). You retain any rights you may have in your User Content.

By providing User Content, you grant us and our affiliates and service providers a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content throughout the world in any media.

You represent and warrant that:

• You own or control all rights in and to the User Content and have the right to grant the license granted above.
• All of your User Content does and will comply with these Terms.

Prohibited Activities

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

• In any way that violates any applicable federal, provincial, local, or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate Aerotlampr, a Aerotlampr employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Aerotlampr or users of the Services or expose them to liability.

Disclaimer

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Aerotlampr EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Aerotlampr MAKES NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES MAY VARY DEPENDING ON INDIVIDUAL FACTORS.

Limitation of Liability

IN NO EVENT SHALL Aerotlampr, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Indemnification

You agree to defend, indemnify, and hold harmless Aerotlampr, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

Term and Termination

These Terms shall remain in full force and effect while you use the Services. We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of the Services for any or no reason, including without limitation, any violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
